Abstract

The present study is to suggest three descriptive indices that summarize the quantitative characteristics of mock-jury deliberations. Applying to the transcripts of the jury deliberations from a simulated trial by jury that was conducted by the Supreme Court of Korea in 2004, the three indices that use ‘Utterances' and ‘Interventions' as the units of analysis appeared to adequately represent the equality of utterance frequencies among the jury members, the richness of intervention paths, and the evenness of the use of the intervention paths. It was explained that these indices may be useful to determine the unique characteristics of different types of juries if consistently applied to the verbatim data of jury deliberations from experimental mock-jury studies and such data are accumulated in Korea in the future. Applying the three indices to the deliberation transcripts from the mock jury trials revealed the possibility that the equality, richness and evenness of the deliberations of the escabinado juries or mixed juries may vary greatly depending on the personal style of the professional judge participating in the deliberation and/or the distribution of pre-deliberation opinions. Key word:Jury Deliberation, Lay Jury, Escabinado Jury, Mixed Jury, Quantitative Characteristic, Utterance, Intervention, Intervention Path, Equality, Richness, Evenness, Indices

Abstract

This research developed the shortened cognitive interview(SCI) that have used effectively at interviewing with eyewitness, victims, and suspects, then examined shortened cognitive interview's effects. Research 1 was examined the effects of CR, CR+RO, CR+CP mnemonic for developing the shortened cognitive interview. Seven days after watching a video-recording of a theft event, 168 participants were randomly allocated to either the experimental group(CR, CR+RO, CR+CP) or the control group. By the result, it's no significantly difference between experimental groups for correct recalls. but CR+RO has significantly less incorrect recalls than other three groups. Therefore, the shortened cognitive interview is consist of CR and RO. Research 2 was examined the effects of the shortened cognitive interview to compare with enhanced cognitive interview(ECI). Seven days after watching a video-recording, 109 participants were randomly allocated to either the experimental groups(ECI, SCI) or the control group. Two interviewer conduct interviewing through the structured interview questionnaire. The SCI has significantly shorter times for interviewing and more correct recalls than ECI. Abstract

The purpose of this study was to investigate a mental health and personality traits of the prison inmates in j correctonal system. The State-Trait Anger Expression Inventory(STAXI-K, Spielberger, 1988), Self-Esteem Scale(Rosenberg, 1965), Hardiness Scale short form(Bartone, 1989), SCL-90-R(Derogatis, 1977) was used to measure level of state anger, traits anger, self-esteem, hardiness personality of 600(576 responded) inmates. The correction coefficient between self-esteem and hardiness were computed using the data. Positive relationships were demonstrated between self-esteem and hardiness, but the interaction affect was not significant. The correlations of the total score of hardiness with the subscales of the SCL-90-R were significant. Negative relationships were demonstrated. Multivarite cluster analysis with the SCL-90-R was performed to derive three subgrups of prison inmates. Finally, Implications ,limitations of this study and suggestions for the future study were discussed. Key words:State Anger, Trait Anger, Self-Esteem Scale, Hardiness, SCL-90-R, Prison inmates
